1. Parties and Agreement

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and the operator of VoiceMyDoc, accessible at www.voicemydoc.com ("VoiceMyDoc," "we," "us," or "our"), governing your access to and use of the VoiceMyDoc web-based service and all related features, content, and functionality (collectively, the "Service").

By accessing or using the Service — including by uploading any document — you represent that you have read these Terms, that you have the legal capacity to enter into a binding agreement, and that you agree to be bound by all provisions set forth herein.

2. Description of Service

VoiceMyDoc is a free, browser-based tool that enables users to upload Portable Document Format (PDF) files and have their text content rendered via automated text-to-speech audio playback. The Service is designed to improve document accessibility for a general audience.

Uploaded documents are processed within the user's active browser session. VoiceMyDoc does not retain, store, or transmit the contents of uploaded documents to any external server. All uploaded file data is permanently deleted upon termination of the user's session. No user account or registration is required to access the Service.

The Service is provided free of charge and is supported by third-party advertising. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice or liability.

3. Eligibility

The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that you meet this age requirement. If you are under the age of 18, you represent that you have obtained the consent of a parent or legal guardian to use the Service and that such parent or guardian has agreed to these Terms on your behalf.

Use of the Service may be restricted or prohibited in certain jurisdictions. You are solely responsible for ensuring that your use of the Service complies with all laws and regulations applicable in your jurisdiction.

4. License to Use the Service

Subject to your compliance with these Terms, VoiceMyDoc grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for personal, non-commercial purposes. This license does not include the right to:

  • Reproduce, distribute, modify, or create derivative works based on the Service or any component thereof;
  • Use the Service for any commercial purpose or for any public display, performance, or transmission;
  • Systematically extract or scrape content from the Service; or
  • Use the Service in any manner that exceeds the scope of access expressly permitted by these Terms.

All rights not expressly granted herein are reserved by VoiceMyDoc.

5. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. Without limiting the foregoing, you expressly agree that you will not:

  • Upload, process, or transmit any document or content that is unlawful, defamatory, obscene, pornographic, harassing, threatening, abusive, or otherwise objectionable;
  • Upload any document containing child sexual abuse material or any content that exploits or harms minors in any way;
  • Upload any document that infringes or misappropriates the intellectual property rights, privacy rights, or any other rights of any third party;
  • Upload any document containing malicious code, malware, viruses, or any other harmful software;
  • Use the Service to process classified, confidential, or sensitive government, military, or national security documents;
  • Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying structure of the Service;
  • Interfere with or disrupt the integrity, security, or performance of the Service or any servers or networks connected to the Service;
  • Use any automated means, including bots, scrapers, or crawlers, to access or interact with the Service;
  • Circumvent, disable, or otherwise interfere with any security-related features of the Service; or
  • Use the Service in any manner that could damage, disable, or impair VoiceMyDoc or its infrastructure.

VoiceMyDoc reserves the right, in its sole discretion, to determine what constitutes a violation of this section and to take appropriate action, including suspending or terminating access to the Service.

6. User-Uploaded Content

6.1 Your Representations

By uploading a document to the Service, you represent and warrant that:

  • You are the owner of the document or have obtained all necessary rights, licenses, consents, and permissions to upload and process the document using the Service;
  • The document does not contain any content that violates applicable law or these Terms; and
  • Your upload and use of the document in connection with the Service does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, or any other rights.

6.2 No Retention of Document Content

VoiceMyDoc does not claim ownership of, access, review, store, or share the content of documents you upload. Uploaded files are processed locally within your browser session and are not transmitted to or retained on our servers. You retain full ownership of and responsibility for any document you upload.

6.3 Your Sole Responsibility

You are solely responsible for all documents you upload and for any consequences arising from such uploads. VoiceMyDoc bears no liability whatsoever for the content of user-uploaded documents or for any claims arising from your use of the Service in connection with such documents.

7. Intellectual Property

The Service, including all software, code, design, text, graphics, logos, and other materials comprising or made available through the Service, is the exclusive property of VoiceMyDoc and its licensors and is protected by applicable copyright, trademark, patent, and other intellectual property laws.

Nothing in these Terms shall be construed as transferring any ownership rights in the Service or any component thereof to you. You may not use any VoiceMyDoc trademarks, service marks, trade names, or logos without our prior written consent.

8. Third-Party Advertising

The Service displays advertisements served by third-party advertising networks in order to support free access to the Service. By using the Service, you acknowledge and agree that:

  • Third-party advertisements may be displayed within the Service interface;
  • VoiceMyDoc does not endorse, control, or assume any responsibility for the content, accuracy, legality, or any other aspect of third-party advertisements;
  • Third-party advertisers may collect certain non-personally identifiable usage data through cookies and similar tracking technologies in accordance with their own privacy policies, which are independent of VoiceMyDoc's Privacy Policy;
  • VoiceMyDoc is not a party to and bears no liability for any transactions or interactions between you and any third-party advertiser; and
  • Your interactions with third-party advertisements are solely at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VOICEMYDOC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

  • ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT;
  • ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
  • ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY TEXT-TO-SPEECH OUTPUT GENERATED BY THE SERVICE; AND
  • ANY WARRANTY THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.

Text-to-speech conversion is performed by automated technology and may contain errors, omissions, mispronunciations, or inaccuracies. No automated text-to-speech output should be relied upon as a substitute for reviewing the original source document, particularly in contexts involving legal, medical, financial, or other consequential matters.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOICEMYDOC, ITS OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL;
  • DAMAGES ARISING FROM ERRORS OR INACCURACIES IN TEXT-TO-SPEECH OUTPUT;
  • DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
  • DAMAGES ARISING FROM THE CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR THROUGH THE SERVICE; OR
  • ANY OTHER LOSS OR DAMAGE OF ANY KIND,

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT VOICEMYDOC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL VOICEMYDOC'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED FIFTY UNITED STATES DOLLARS (USD $50.00).

11. Indemnification

You agree to defend, indemnify, and hold harmless VoiceMyDoc and its operators, affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service in violation of these Terms;
  • Any document you upload to the Service;
  • Your violation of any applicable law, regulation, or third-party right; or
  • Any claim that your use of the Service caused damage to a third party.

VoiceMyDoc reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with VoiceMyDoc's defense of such claim.

12. Suspension and Termination

VoiceMyDoc reserves the right, in its sole discretion and without prior notice or liability, to restrict, suspend, or terminate your access to all or any part of the Service at any time and for any reason, including if we believe that you have violated or acted inconsistently with these Terms.

Upon any termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 6, 7, 9, 10, 11, 15, and 16.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy. In the event of a conflict between these Terms and the Privacy Policy with respect to data practices, the Privacy Policy shall control.

VoiceMyDoc reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any such modification constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms and any dispute arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Nevada, United States of America, without regard to its conflict of law principles.

15.2 Informal Resolution

Before initiating any formal legal proceeding, you agree to contact us at information@voicemydoc.com and provide a written description of the dispute, your name, and your proposed resolution. We will attempt to resolve the dispute informally within thirty (30) days of receipt of your notice.

15.3 Binding Arbitration

If the dispute is not resolved informally, you and VoiceMyDoc agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.

15.4 Waiver of Class Action

YOU AND VOICEMYDOC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

15.5 Jurisdiction

For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.

16. General Provisions

  • Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and VoiceMyDoc with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
  • Severability. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
  • Waiver. No failure or delay by VoiceMyDoc in exercising any right or remedy under these Terms shall operate as a waiver thereof.
  • No Agency. Nothing in these Terms shall be construed to create a partnership, joint venture, agency, franchise, or employment relationship between you and VoiceMyDoc.
  • Assignment. You may not assign or transfer any of your rights or obligations under these Terms without the prior written consent of VoiceMyDoc. VoiceMyDoc may freely assign these Terms without restriction.
  • Force Majeure. VoiceMyDoc shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, or failures of third-party infrastructure.
  • Headings. Section headings are for convenience only and shall not affect the interpretation of these Terms.
